I have no idea. I do know that it is an incorrect way of determining guilt or innocence. There are those who have an ability to "beat it" and then again, there are those who have a strong sense of responsibility and will test positive when they are innocent. Those things can never be relied upon and are used way too much and in an erroneous manner by the Prosecutors.
