Can a 19 year old boy go to jail for suppose to molesting a girl when he was 11?

Can a 19 year old men go to jail for supposed to molested a girl when he was 11 in California?".

Okay... how old was the girl? If she was also 10-12 yrs old how many of you can claim you never 'played doctor' with a member of the opposite sex? Hmmm?

It's time we put a little sanity around this issue.

If he forced sexual physical contact on some girl when he was 11 and she was 4 yrs. old... the kid has/had some really serious issues that I don't see putting him in jail 8 years later would solve. He should have been placed into a program of mental health care at that time, but since he wasn't he needs to be now and a thorough analysis done... if after that analysis is complete he is deemed to be a danger of repeating this type of behavior he should be incarcerated. Otherwise, what is gained here by jail time? Is punishing this guy 8 years later going to stop another 11 year old from touching a girl inappropriately?

If he forced sexual physical contact on someone in his own age group (remember we're talking 11 years old here... the beginning of puberty) I think you get both sets of parents involved in discussion with both kids (separately of course... certainly not right to further traumatize the girl) and figure out exactly what happened. Could be similar to the above situation and the kid really requires mental health care.

I'm not trying to defend his behavior in any way, shape, or form. Our children need to understand and respect other people's right to not be touched physically unless they want to be. Seriously, though... think back to 4th and 5th grade... in my school there was a 'dare' amongst the boys to kiss a girl... there was no 'sexual molestation' occurring and I don't think the girls thought about it that way either... for the most part (thank you God for giving me great parents who taught my siblings and I about sex from age 8 on up) most kids have no idea about sex in our country at that age and experimentation is both natural and understandable. I think we put too many 'adult' interpretations on children's actions today and respond in that manner.

Just my two cents of course.

Yes!!!! In the state I live there is no statute of limitation on a felony. I believe you would still be charged as a minor since it occurred when you were a minor.

First of all, one must know the laws in that state, and in the particular jurisdiction.

Also, one must find out what the statute of limitations are in same state/jurisdiction.

Not that this in any way makes it right, but hopefully it was an isolated incident. If not, said 19 year old is statistically doomed to re-offend. And, young children anywhere near him, are in grave danger.

He needs help either way.

Actually, I believe the statue of limitations on rape is 7 or 8 years, unless that's changed recently. Murder is the only crime without a limit.

Why not erase any doubt and call a lawyer in your area? You wouldn't even have to give them your name or any info, just ask your question.

I agree with engmaticsol. There's no statute of limitations on rape nationwide in the U.S. and yes, he would be tried as a minor because of his age at the time. But I don't know how well it will hold up in court since 8 years has passed before charges were brought against him.

gotta look up sentencing laws in CA. here in WA, juveniles can be and are charged with sex crimes. you really don't want to know what is possible...usually these kids have been victimized themselves, it is a crime that perpetuates itself, very sad

Lonelyashell, where are you getting your information? Children under the age of 14 are considered not to be old enough to give consent. If a 14 year old had sex with a 2 year old, that would be rape. How can a 2 year old agree to sex? If a child of 14 has sex with a child of 15, that may be something that wouldn't be illegal, but 14 and 2? That is illegal any way you look at it in any state. Look up your facts. Sheesh.

I think yes, I believe the age you can be charged with a crime is 11, I believe it's only 10 years and younger that are not.

I can tell you that a boy I know was 13 and let a 10 yr old child he was babysitting touch him when he lived in one state and moved to AZ and was charged and convicted when he was 19 for it. Went to prison there.

there is a statute of limitations here in baltimore, md it's 8 years so he'd get off scott free

if he did the crime as a minor he should be tried as a minor unless he has a really bad lawyer

These laws very from state to state.

I will tell you what is even more amazing.. many "so-called sexual predators" are men above the age of 18 who happened to fall in love with a woman of less than 16.. that is statutory rape in most states.

ITS THE SAME ACROSS THE BORD. AS LONG AS BOTH PARTIES AGREE TO IT, AND BOTH PARTIES ARE EITHER ABOVE OR BELOW THE AGE OF 18, NO MATTER WHAT AGE THEY ARE INDIVIDUALY, THAN NO LAW HAS BEEN BROKEN. AND THATS THE SAME EVERYWHERE IN AMERICA. FOR EXAMPLE, I KNOW ITS SICK, BUT IT IS LEGAL FOR A 16 OR 17 YEAR OLD TO HAVE SEX WITH A 1 OR 2 YEAR OLD AS LONG AS THEY BOTH AGREE.
