MY parents are current getting a divorce. We have not live together for almost 2 years. My mom is stuck with my sister and I. She bears all the responsibility and my dad is free without paying any child support. My dad sent all his money to china to build his own damn house. But my mom have all her saving in America and in the banks. SO if they get a divorce, would we have to share half of our share with him and he have nothing to share with us? HE HAVE BEEN FREE FOR 2 years without any responsiblity. This is unfair... please if anybody know if this true and have any advice... please help me

Force him to declare the property ,and taxes owned on it in America . Then it become divisible in a divorces . Report it to the tax agency as undeclared foreign property. Get documentation as to the separation , all saving after separation is not dividable . Further details will have to come from an Attorney .

If you have tangible proof (bank statements, receipts from builders in China, etc) of your dad having property or buildings in another country, you may be able to have moms attorney subpoena his financial records/assets & introduce them as evidence during the divorce proceedings.

The burden of proof is on your mom (or her lawyer) to prove it and show that assets are trying to be hidden or diverted.

Legally your father has to declare all monies on the financial statement. If you can find some kind of paperwork that states he has more money then what he is showing then he will be in big trouble with the law.

Be strong you will find what you need. Don't let money ruin your lives. What goes around will come around to your father.

Good luck
