My brother has sought legal advice for his former defacto separated 2 years now, taking his two boys 6 and 8 out of the state and more than 2000ks away..she no longer answers his calls..there was no reason except she has remarried..usually contacted boys every night at 7pm.and had them every holidays for the whole holidays...we have no address for them...no phone number and haven't spoken to them for 3 months...legal advice said unless we want to spend up to $50,000 in legal custody battle there is nothing we can do..she has no reason..the relationship ended amicably..but is preventing contact...what to do?fathers have rights but they are not enforced..so unfair..he loves them..anyone been through this??advice please...ps. in australia, laws vary from state to state..they were never married and because it was agreeable when they separated for her to return toher parents he agreed with no court order...since then she has moved 3 times, interstate is illegal without consent..everything she has done is illegal however there is NOONE WHO WILL ENFORCE THIS..now he feels if he finds them he will have to kidnap..as her relationship is known to be violent

Child support, and visitation, are two different issues.....You still have rights to see the child/children, even if you have not been ordered to pay (even if you been ordered, and haven't paid, the custodial parent is not suppose to keep you from seeing the child/children...it's not the best thing for the child)....

I'd go back to the court, in the county where the kids were born....and go from there....in my state, depending on how much you make each month, you can get legal aid, for nothing, especially if there is abuse in the relationship....

Guys are not given the same rights as mothers, and it's not fair, you are right....Many times, they would be better suited to be the custodial parents, too.
