Resolved Question

Temporary Work to Working Full time with same employer?

I am currently employed with an agency doing temporary work and now this employer doesnt want to use the agency basically because they have ripped them off with some other matters.

The people I work for are willing to employ me full time and I am wondering if there is any legal obligations or ways to get out not paying them there so called fee to get there rights on me. Can they not just tell them we dont need her any more and employee me. That just seems to easy. Yes, I could look up the contract I have signed but I dont know where it is.

Thanks for your help :)

A company sleazy enough and crooked enough to screw the Temp Agency out of what is rightfully theirs will ultimately be sleazy enough and crooked enough to screw you too - to say nothing of your complicity in this matter. Temp agencies run into this gambit all the time and will go after you and your employer. Find that contract and read the terms carefully.

El is absolutely right! I temped off and on for quite a few years and can tell you that what you sign when you go to work for them is a binding contract which states you won't go to work for one of their clients without the client paying a pre-established temp-to-perm fee. They sign one, too. Both you and the client company could get into some serious legal trouble if you try to do an end-run around it and get caught. (They do have lawyers, you know!) Even if you do get away with it, as El says, these people would probably have no compunction whatsoever about pulling the same crap on you. I say ask the temp agency for a reassignment and consider yourself lucky to be free of of them...or just sign on with another agency.

I assume the employer who got you from the agency has a legal obligation to pay a finder's fee. I think you're off the hook.
