Well, I'm sure the media profited out of the story. they wouldn't have done it if they didn't. They didn't ask him and they used his image. I imagine he has a right to some of the profit - don't you? Or can the media just come along and use your image for profit and not ask, compensate you?
according to whom? I can see someone defending the homeless bloke against the media. I thought fair use would take into account the disparity between the user and the used.

I allow kindness, yes. I don't appreciate people digging for more money after someone made a gesture of kindness. Being a war veteran still doesn't change his current actions, that's a plea for pity and possibly commits the fallacy argumentum ad passiones. Come now Ms. Lawyer :P

He went to war for the American Dream, yes. I don't think this can be expanded into a larger matter, but really, it's because our country doesn't take care of its troops.
He is still, in this situation, being ungrateful for the kindness shown to him.
In the larger picture, perhaps the federal government could be considered ungrateful for his service. As individuals, we are not ungrateful because we generally have no way of knowing who did what before they ended up on the streets.
