    It depends on the person whose back gets scratched, and the manner in which it became scratched. If you were trying to squeeze through a tight opening, and happened to scratch your back -- it would remain innocent. If you happened to pay a person to dress in unusual garb with instructions to scratch your back -- that scenario might not remain innocent for long.
