People Change

I am a felon, I was 17 and I got into a fight with a 16 yr old in May of 1996. I got charged with Strong Armed Robbery because she was found walking down an alley without her shoes. I had never gotten into trouble before but I had a major chip on my shoulder and affiliated with gangs. I was waived into adult court. Since she was 16, my Strong Arm Robbery charge was dismissed and in it's place I was charged with Substantial Battery, Aggravated Assault, Bodily Harm to a Child and Theft from a person; all felonies. I was assigned a public defender and he told me to take a plea of three years, after I had already sat in jail for about 6 months. He told me that if I plea guilty to at least one of the charges the rest will be dismissed and read-in. He also said that I would only do 9 months and then be eligible for parole. I ended up pleading guilty to Theft from a Person since it had the least exposure to a heavy sentence. I was sentenced to 3 yrs, like he said I would.  After 9 months I did go in front of the parole board. I was now in prison and my behavior was exemplary..I never got into ANY trouble while in there. The parole board said I was manipulating the system because with the type of crime that I was convicted of, there was no way that I could behave. They gave me a 36 month defer; which meant that in 36 months they would review my case again. I ended up doing my MRD. (maximum release date) I was released in Nov. of 1998. 

I never got into any type of trouble. While on parole, I had to move to another city, I had my parole transferred, my files ended up getting lost!! I went to the local parole office every friday after work and filled out a sheet, to prove that I was not trying to obscound... my files were found 2 weeks before I was done with being on papers.  I still have not gotten into trouble. 

I worked at a Domestic Violence shelter for over 5 yrs and the shelter ended up getting a new Director...she fired me a year later...word had gone around that she did not like that I was a felon....so I made sure I did my job right ALL the time....she LIED about my job performance and fired me...I know that it was because of my background.  A lot of my co-workers also knew and they left the shelter shortly after I left. I took this opportunity to better myself. I started to go to school to become a Medical Assistant to then be a nurse. I ACED my first semester...even advanced Medical Terminology was passed with an A+!!! At the beginning of my second semester I get a phone call from the dean of the health department telling me I have been kicked out of the program because of my criminal background.  SO!! Here I am at 30...almost 31 with no education, I keep hitting the wall of felony conviction over and over again...never ever did I commit a crime again but that doesnt count. I just want to be able to get a career going in something I like to do so that I can provide for my 2 children...and it seems so impossible.

That stinks that they wouldn't let you graduate. I almost got kicked out of the program of Bachelor's in Social Welfare recently because of my charge of Vehicular Assault, one car accident with passenger injured. My accident happened in the summer and I didn't disclose it to the social welfare program until my teacher of my Practicum Seminar found out the last day of the program. She had an attitude and said she'd have to discuss my situation with the director. She said I was unethical by not disclosing my charge to everyone and I put the program at risk. I said I wasn't convicted of the charge as of yet and I think that was the reason they let me graduate. I could've been kicked out if the conviction happened at the time I was in school. I was then told that it will be unlikely that I will get hired as a social worker and I am not allowed to use the school for a reference if I was to continue my education. Still looking for work.

I don't know the state you live in, but do check out the possibility of a governor's parden. With your education and drive, you may be ale to apply without the help of an attorney. Or do all the research and see if an attorney would review your application before you submit it. Also, check the laws regarding an expungement. Often the county where your conviction is held might have the paperwork to apply for an expudgement. Never Give Up!

You likely do NOT have a case against the college. Health care has all kinds of regulations relating to criminal records in the industry. If it was any other job field you would probably have a slam dunk win, but not so sure with health care. I know I had to have a background check at nearly every step in the education process AND for every job (including part time when I was already licensed and working at another service.)<br />
You might have some option to get it reclassed as juvie and expunged or something. I'm not a lawyer so I don't know. Maybe look to some kind of solid blue collar job that pays well, or the military (would be tough, but possible to get in).

I didn't know that...I will be contacting the school to see if they can put it into writing.
