Ms Cox Loses Her Case Again In Court December 9th 2010

For any one reading this - Janice Cox's appeal was heard in Circit Court, Orange County Virginia on Dec 9th, 2010 and the Judge found that she did not meet the burden of proof of her law suit contending that I was a bad breeder, and misrepresented my dogs on my website. The judge found for the defendant, Gail Forrest. Ms Cox stated in court she plans to appeal this second loss to the Supreme Court of VA. Perhaps 3rd time will be the charm? for her.

Ms Cox refuses to accept any responsiblity for Macy's behavior from the age of 10 weeks to 11 months when she was living with Ms Cox - for someone who keeps saying she is submissive and not strong or dominant - she is being very dominant, and agressive in the continued effort to tarnish my good reputation and the reputation of the dogs I breed.

Perhaps if she had put as much effort into training Macy as she has in pursuing a frivolous law suit, Macy would have been better trained?

I would first like to congratulate Gail Forrest on her win in court 10-09-10. I would like to say that by addressing her in court as Mrs. Forrest I will from now on address her as "Mrs. Forrest". I will respectfully refer to her as M.F. from this point on, to make it easier to type. I would like to stress in black and white, M.F. stands for Mrs. Forrest. <br />

I would like to apologize to anyone reading this as it has gone far further than I ever wanted it to go. I have been so very misquoted in all of this. Yes, I have posted in several places on the internet about my experience. I have had to go back and re-read my posts because of what is being said in rebuttal. I have NEVER said anything bad about any of M.F.'s dogs. I have never said she is a bad breeder. I have said I have had a bad breeder experience. M.F. is misquoting me saying I am saying she is a bad breeder. If you will re-read anything I have put out there, you will see I have not said she is a bad breeder or her dogs are bad. I am concerned and referring to one dog only; Macy. Her misquotings are quite out of hand. <br />

Yes, M.F. did win in court yesterday. In my opening statement, I said, "This is about a breach of contract. I promised to pay Mrs. Forrest $1500.00 for a submissive puppy. I kept my end of the agreement, Mrs. Forrest did not. She supplied me with a dominant puppy". The judge asked me to speak louder. He stated at the end I did not provide my burden of proof. I had the cancelled checks on me but did not enter them into evidence. I truly believe the man did not hear me say I paid $1500.00. <br />

M.F. kept stressing she had put certifications on Macy. This simply proves Macy is trainable. The case is not about Macy being trainable. The case is about Macy being dominant. M.F. kept insisting I did not train this dog and did not socilize her. I spent a tremendous amount of time with this dog, (which my witnesses testified to). Does M.F. have proof I did not socialize and did not train? Did she have a private investigator on me the entire time I had Macy 24-7. I took Macy more places and spent more time with her than any I have ever owned. M.F. also said I never finished obedience classes. The first obedience classes I had Macy enrolled in, Macy missed the very first class because she was in heat. I went, she didn't. The last class I was sick. This first series M.F. said I did not have a certificate for her. Well, there is a reason for her not having a Star puppy certificate, they DIDN'T give certificates for the Star puppy class (and M.F. has been informed of this in the past). The second series of Obedience classes Macy was in at a school M.F. recommended I take her to. In this series of classes the instructor was trying to make Macy sit and she gave him a hard time. The instructor stated, "this is a dominant dog". I wish I could have had him for a witness, as he is an expert. And to be fair to M.F. she is correct, Macy did NOT finish this series of obedience classes. There is a good reason for Macy not finishing that M.F. refuses to tell. Macy did not finish the second series of obedience classes because she was RELINQUISHED to M.F. and this is how the entire court case went. The entire story was not told and significant parts of events were left out to her advantage. <br />

In the first court case in small claims court, M.F. openly admitted without being cross examined but by her own admission, she stated, "I am the most dominant in my house". I asked her yesterday if she was a dominant personality and she said, "No". I then asked, "Do you recall in the first case you admitting to the court you are dominant?". She said, "I don't remember". <br />

I have owned six other dogs in my lifetime. Two were Dobermans and I never had any trouble out of them. I presently own a Chow mix and an Irish Setter. I owned a Great Dane the last three years of her life. I have been to obedience classes with two other dogs and had no trouble. I have never relinquished any dog and have had all -their entire lives. I have a new Doberman puppy and am having no trouble with her. I don't have to worry if she is going to do something unpredictable. She now has a certificate from Beginnners and also a CGC. <br />

After I took possession of Macy, my sister and I went to visit M.F. with Macy. When we were in the kitchen, Macy was playing with M.F.'s five week older Canadian puppy. Macy's play turned into aggression and M.F. jumped up out of her chair in a flash and pinned Macy to the floor. That is not the love everybody every living thing personality I asked for. (M.F. states she has health problems but she sure had no trouble flying out of that chair). <br />

M.F. told the court about her gentle 85 year old mother and how Macy is on the couch beside her 85 year old mother. Yes, this is the woman who was smacking Macy with a fly swatter when my sister and I walked into the living room on one visit <br />

M.F. stated if I spent as much time on training Macy as I did on the internet telling about this experience I would not have had the problems I had with Macy. Well, M.F. is filing for disability but she can go train dogs three nights a week (and pin a dog to the floor). If she spent as much time looking for employment as she does going all over the net we taxpayers would not have to support her big butt. (The judge can see that for himself-she can't band aid that one). <br />

Lastly, again M.F. has misrepresented something in court. The judge said if I wished to appeal, I could have copies made of the evidence at the clerk of court. I questioned him about the copies so I had a clear understanding of what he was describing. I did NOT say, "I am going to appeal". M.F. has said all over the net now that I am appealing. Those words NEVER came out of my mouth. <br />

I was trying to understand my feelings after court. I came to the conclusion that losing the money was not what was upsetting. It was the way things were told in court and things that were said about me that were so far from the truth that was so very hard to comprehend. It was also about the way someone I thought of as a good friend and I had a great amount of respect for -could turn on me and be so hostile. The dog simply just did not work out & as a breeder, this should be expected sometimes. I now can never see Macy again or know how she is. <br />

One dog that was returned to M.F., on one visit, we were all walking outside and the dog did something M.F. did not like. M.F. smacked the cage and yelled, "Stop it, that is exactly why you are back here, you stupid dog". I pray Macy is treated better than that. <br />

I will say it again. My entire point of posting on the net is to ask people to be careful before you sign a contract and to make sure they read a contract and make sure it is fair. No other breeder would have treated me this way and I don't want you to ever be treated this way, either. Please, BEFORE looking for a breeder, go on the internet and look for your local breed clubs. They know who the honest, ethical breeders are and will steer you away from a BREEDER EXPERIENCE that may turn bad. <br />
