Bankruptcy Advice, Please

A personal story in the experience: I Must File For Bankruptcy
W e have $80,000+ in credit card debt.  Have used the cards for consolidation only for the past ten or so years, so are not using credcit to live on, but are burdened by the debt obligation and unable to discharge it.  Lost my job last week.  No prospects.  Will file chapter 7.  First atty I spoke to wants $3,5000 minimum to take the case (TX law allows him to charge that).  Looking for a less costly way to succeed at this.  Any ideas?

Npanxx, we had to file Chp 13 three years ago, probably should have done the 7 but we had too much equity in the house. My wife had to go in the hospital for 6 months and, as she made more money than I, we weren't about to try to catch up on the payments.

A friend of mine had to do 13 so he went out, took out all the cash advances he could, bought lots of clothes, used his cards for gasoline, utitlities, etc (so the cards couldn't/wouldn't come pick the things up). He wound up with about $40,000 cash, clothes, and fed a bunch of us at Applebees pretty damn nicely.

I didn't go that route because I'm sure it's pretty illegal if you get caught- apparently he didn't... go figure.

Oh, the point I was originally trying to make was be careful of Chp 7 because the debters CAN repo stuff. I would have lost my Avalanche which was paid for and, as I said, possibly our house (we had around $50k equity in it). Our Chp 13 note for around 200k debt was $275.00 a month.

Maybe that'll help. I do know that our attorney had his fees worked into the court agreement.

Can you sell property to cover those?
In any case, good luck. I dont know what else to say. It sounds like you have a hard time ahead, even if you might not realize it yet.

I think 3500 is too expensive. I would shp around, ours was only 1500.

We were referred to a very decent attorney by Pre-paid Legal. In this mess, it's the best $15 a month I've spent yet. The attorney charged $1500 and the referral was worth a 25% discount, offsetting the $299 filing fee. By the way our case is pretty complicated. I am sure, even without the referral, you can find an attorney for much less.
